European customer commitments. Indian delivery operations.

GDPR consulting for Indian service providers.

A European contract can introduce detailed privacy commitments across engineering, support and subcontractors. CyberVantage360 helps Indian organisations translate those commitments into workable instructions, controls and evidence. Start with the service actually provided and the decisions the customer expects you to support.

Start with the operating decision

Distinguish legal scope from customer obligations.

Under the European Commission's scope guidance, GDPR applicability depends on relevant establishment or targeting and monitoring criteria. An Indian address or a European customer name alone does not settle every obligation.

Record the processing relationship and customer instructions separately from direct legal applicability. The assessment can then identify the access, retention, incident and subcontractor practices needed to support the actual service contract.

India context

Maintain separate Indian and European legal decisions.

MeitY publishes India's Digital Personal Data Protection Act, 2023 and Rules, 2025. Their application and current implementation requirements need a separate review. A European customer assessment should not be sold as automatic coverage of the Indian framework.

For a delivery team spanning development, testing and support, the practical challenge is knowing which customer information can enter each environment. Document the permitted route before staff use production material to reproduce a fault.

Agreed outputs

Give customer-facing and delivery teams the same facts.

Agree a service-level assessment that follows the information beyond the contract signature.

01

Service and instruction record

Describe what the customer instructs, who can approve variations and which activities need legal clarification.

02

Delivery data map

Trace production access, test datasets, support attachments and subcontractor handling across the selected environments.

03

Control and evidence plan

Assign changes to access, retention, incident escalation and supplier checks. Specify the records that demonstrate operation.

04

Customer response pack

Organise accurate scope statements, limitations and supporting evidence for due diligence without promising untested controls.

Practical implementation

Review the exception as well as the standard process.

Select a recent support escalation and trace who requested, approved and accessed the information. Check whether temporary copies and external assistance are captured in the normal workflow.

Agree how customer instructions change when a new feature, support location or subcontractor is introduced. The project should leave a usable approval route and a named owner, not a questionnaire that becomes obsolete at the next release.

Illustrative operating decisions

Two Indian delivery decisions.

Hypothetical examples, not client case studies or claims of completed engagements.

A Bengaluru software team needs a production extract

A hypothetical vendor is debugging a European customer's fault. The engineering team asks for a full database although a reduced test case may be sufficient.

The programme establishes an approval route, a minimum-information approach and a controlled work area. Closure includes checking that temporary material has been handled according to the agreed instruction.

A Pune service centre changes subcontractors

A hypothetical processing service adds specialist support during a busy period. Procurement sees a staffing change; the customer contract may treat it as a change in the processing chain.

The assessment identifies the decision owner, proposed access and customer communication needed before onboarding. The handover includes incident contacts and evidence of access removal when the arrangement ends.

A clear engagement basis

Support the commitment you can actually deliver.

The engagement provides scoped findings and implementation support. It does not award universal GDPR certification, settle disputed legal applicability or guarantee a customer's supplier approval. Agree specialist legal input and the evidence-sharing boundary in advance.

Before you commission the work

Questions from Indian delivery teams.

Does any European customer make us directly subject to GDPR?

Not automatically. Review territorial scope, the processing role and contractual obligations as separate questions.

Can a customer questionnaire replace the assessment?

It is useful input, but answers should be checked against the actual delivery environment and evidence.

Can we reuse production data for testing?

Assess the purpose, instructions and safeguards before doing so. Prefer a suitable reduced or synthetic dataset where practical.

Is Indian privacy-law work included?

Only when expressly scoped. Maintain distinct legal decisions even where operational controls and data maps can be reused.

Can the project cover subcontractors?

Yes. Define which providers and interfaces are included, the evidence available and who approves unresolved risks.

What is needed for a proposal?

A service description, delivery locations, customer requirements and major systems are useful. Do not send production data with the initial enquiry.

Sources and scope of this guidance

European Commission: application of the GDPR; MeitY: Digital Personal Data Protection Act, 2023 and Rules, 2025.

Official references checked 13 October 2026. The implementation examples are practical recommendations; legal applicability and the agreed assurance scope need their own review.

Plan the engagement

Make European customer commitments workable.
